GENERAL TERMS AND CONDITIONS OF SALE OF WWW.OTZLABMADRID.COM

The purchase of any product offered through the official website www.otzlabmadrid.com (hereinafter, the “Website”) is subject to these General Terms and Conditions of Sale (hereinafter, the “General Terms of Sale”). The seller is PERFUMES Y DISEÑO COMERCIAL, S.L. (hereinafter, “PYD”), with registered office at Isla de Java, 33 – 28034, Madrid, Spain, registered in the Madrid Commercial Registry, Volume 8996, Page 60, Sheet M144571 and with Tax ID (NIF) B-81061616.

Orders may only be placed by natural persons acting as end consumers (hereinafter, the “Users”) with the purpose of purchasing the products offered on the Website without profit intent. Therefore, the resale or distribution of PYD products purchased through the Website is strictly prohibited.

PYD may update these General Terms of Sale at any time, and the User will have access to the most updated version through the link titled “General Terms of Sale” on the Website.

To place any order through the Website, the User must accept these General Terms of Sale at the time the order is placed.

For the purposes of these General Terms of Sale, “Products” means all perfumery items and related products offered to the User.

User Data and Purchase Process:

The purchase is completed without the need to create a password-protected account or a permanent profile.

 

However, the system automatically generates a technical identifier associated with the email address provided by the User for the sole purpose of managing the order and enabling access to the order history linked to that email. Such access does not constitute a user account in the traditional sense.

 

To place an order, the User must provide the necessary billing and delivery information.

 

It is essential that all fields be completed with accurate and truthful information, as this data will appear on the invoices issued and will be used for delivery.

 

PYD reserves the right to revoke access to any User at any time and without prior notice if abusive, suspicious, inappropriate, unlawful, or otherwise risky behavior is detected for the Website and/or PYD or its users.

 

Order Confirmation:

All Products included in an order placed through the Website are subject to availability and must be expressly accepted by PYD.

 

The purchase will only be considered formalized when PYD sends the corresponding order confirmation or pro forma invoice (hereinafter, the “Order Confirmation”).

 

If no Order Confirmation is issued and a payment has already been processed, PYD will refund the full amount.

 

These General Terms of Sale and any document expressly referred to herein constitute the entire agreement between the User and PYD (hereinafter, the “Contract”) and replace any prior agreement, promise, or arrangement made verbally or in writing.

The Contract covers access to the Website with the possibility of purchasing Products displayed therein, as well as the availability of associated privileges and prices.

 

PYD reserves the right to remove any Product from the Website at any time or to modify any material or content.

 

PYD may also cancel an order after confirmation, refunding any amount paid by the User. This refund will constitute PYD’s sole liability.

 

If PYD offers the possibility of receiving a gift, its reception will depend on availability or the existence of a promotion.

 

The User may check order details at any time in the “My Orders” section using a passwordless login system (via temporary access code or link sent by email).

 

For any comments, questions, or suggestions regarding Product purchases, the User must contact PYD through the contact form available on the Website.

 

Price and Payment:

The price of the Products will be the price shown on the Website at any given time. If an error is discovered in the price of any of the Products included in the order, PYD will inform the User as soon as possible of the new price and the reasons for the increase, giving the User the option to reconfirm their order at the correct price or cancel it. Prices will include, where applicable, VAT or other taxes and/or fees applicable under current legislation, but do not include shipping costs, unless otherwise indicated or special promotions apply.

Product prices and shipping costs are subject to change at any time, but any changes will not affect orders that have been confirmed and are in the process of being shipped.

Prices on the Website are shown in the currency corresponding to the destination country and include taxes.

Shipping costs will be borne by the User according to the rates in force on the Website and may vary depending on the destination and the amount of the order.

The current rates and delivery methods can be consulted in the section “Delivery methods and associated rates” of these General Terms and Conditions of Sale.

Once the Products to be ordered have been selected, and before making the payment, a final summary will be presented identifying the Product(s) purchased and their total price (including taxes and shipping).

The next step will be to Confirm the Order and make the payment following the instructions provided.

Payment Methods:

The payment methods available for payment will be Visa, MasterCard, PayPal, Apple Pay, and Google Pay (subject to the availability and operations of each bank and its app).

 

By clicking on “Authorize Payment,” the User confirms that the credit card belongs to them. To minimize the risk of unauthorized access, credit card details will be encrypted. Credit cards will be subject to checks and authorizations by the issuing entity. If the issuing entity does not authorize the payment, PYD will not be liable for not being able to process the order, for delays in processing it, for non-delivery, or for any other similar circumstance.

 

Order Delivery:

Before placing the order, the User must select the delivery method that best suits their needs. The delivery dates for the Products will be those indicated by PYD in the Order Confirmation or subsequent shipping confirmation document, and are approximate, therefore PYD will not be liable if for any reason delivery cannot be made on those dates. The Products will be delivered to the location and under the conditions specified in the Order Confirmation and selected by the User.

 

Delivery Methods and Fees:

The Products will be delivered to the User's address.

 

The rates associated with the delivery of the Products will vary depending on the option selected by the User:

Returns:

The User is contracting as a consumer, and may therefore withdraw from the Contract at any time within 14 calendar days from the date of delivery of the order without justification, provided that the Products are in the same condition as when they were delivered, have not been opened or used, and retain their original packaging and/or seal, together with any accessories or gifts that accompanied the order. Otherwise, PYD may refuse the return for reasons of hygiene and safety inherent to perfumery products.

 

In the event of a valid withdrawal, PYD will refund the User the price paid for the Products. Shipping costs paid at the time of purchase will not be refunded.

 

The User may exercise their right of withdrawal by sending the document provided for this purpose in the “Right of withdrawal” section of the Website or directly by email to info@otzlabmadrid.com stating their wish to withdraw from the Contract.

 

The collection of the Products will be managed by the transport company designated by PYD at the address provided by the User.

 

The costs of returning the Products will be free of charge.

 

PYD is not responsible if the Product you wish to return is lost, misdirected, or sent after the deadline. In this case, the User is responsible for the risks involved in shipping their purchase.

 

Products purchased through the Website that have been customized are not subject to this clause and, consequently, will not be replaced or refunded by PYD unless the User can prove that there has been a fault in the customization and that this is attributable to PYD.

 

Defective Products:

If the purchased product is defective, PYD shall proceed, as appropriate, to repair, replace, or terminate the contract, at no cost to the User. PYD shall be liable for any lack of conformity that becomes apparent and is demonstrated by the User within two years of delivery.

The User shall have a period of two months from the date of delivery to inform PYD of any defect identified in the product.

PYD shall carefully examine the returned product and inform the User within one month whether the product claimed is to be returned or replaced.

 

Retention of Title:

Ownership of the Products transfers to the User only once full payment has been made.

 

Industrial and intellectual property rights:

The User acknowledges that all trademarks, designs, illustrations, photographs, and/or other industrial and/or intellectual property rights relating to the Products, as well as any other elements that form part of the Website, whether registered or not (hereinafter, the “Intellectual Property Rights”) are the exclusive property of PYD.

 

Placing an order does not grant the User any right to use, register, or identify the User or their business with the Intellectual Property Rights. The elements of this Website are designed for the purpose of offering the sale of the Products. Copying or using these elements does not imply the transfer of any rights over them. In this regard, the reproduction, publication, transmission, modification, or distribution by any means of the elements that make up this Website (including software) is expressly prohibited.

 

PYD reserves the right to take appropriate action in the event of a violation by the User of the provisions of this paragraph.

 

Liability and Disclaimer:

PYD's liability in relation to any Product shall cover both the price paid by the User and any damages caused to the User.

 

However, PYD accepts no liability for loss of income or sales, loss of business, loss of profits, or any other type of indirect damage that the User may suffer. The resale of Products by Users is expressly prohibited. 

 

Modification of These Terms:

PYD reserves the right to review and modify these General Terms and Conditions of Sale at any time. Orders placed by Users shall be subject to the policies and conditions in force at the time each order is placed.

 

Applicable Law and Jurisdiction:

These General Terms and Conditions of Sale are subject to Spanish law, therefore sales transactions shall be deemed to have been made at the registered office of PYD. In the event of a dispute between the parties to this Agreement, the competent jurisdiction shall be Spanish, with the courts of the User's place of residence having jurisdiction.
